Terms and conditions
This English text is for convenience. The Dutch version is legally authoritative. Algemene voorwaarden
In brief
- A contract exists only once you accept a written quote and pay the 30 % deposit.
- You may cancel free of charge up to 7 days before the session; after that we keep the deposit, except for withdrawal or force majeure.
- Consumers who book at a distance have a 14-day right of withdrawal, with the statutory exceptions.
- Once the invoice is paid in full, phonogram producer rights in your takes sit with you. Dutch is the binding language.
1. Scope
These terms apply to every job for Cijativojaconsulting B.V. (Cijativojaconsulting), a private limited company (B.V.) in Amsterdam, Chamber of Commerce 99300652, VAT NL851172726B01, Overtoom 141, 1054 HG Amsterdam. Phone 020 737 0842, e-mail [email protected]. Director: Maarten van Dijk.
They cover Vocal recording, Mixing, Mastering, Podcast recording and Voice-over & dubbing, and combinations of those. The order of documents is: (1) the accepted quote, (2) these terms, (3) for businesses that hand us other people’s data the data processing agreement — which wins on that subject. The privacy policy is information, not a contract change.
Visiting the site or sending the contact form does not bind you. We depart from this text only in writing and expressly. We reject a business customer’s purchasing terms unless we accept them in writing.
The Dutch version is binding. English is a translation. Identity and host are in the legal notice.
2. Definitions
| Term | Meaning |
|---|---|
| Studio / we | Cijativojaconsulting B.V., trading as Cijativojaconsulting. |
| Client / you | The person or organisation that accepts a quote. |
| Consumer | A natural person acting outside a trade or profession. |
| Business client | Any client acting in the course of a trade or profession, for example a label, production house or agency. |
| Quote | The written offer with service, date, duration, price including and excluding VAT, deposit and any special terms. |
| Session | The reserved block in the studio, with an engineer. |
| Working day | Monday to Friday, other than a generally recognised public holiday in the Netherlands. |
| Deposit | 30 % of the VAT-inclusive price, paid as a part-payment on booking. |
| Recording | The sound fixation made during a session, including session files. |
3. Offer and formation
A request by form, e-mail or phone is an invitation to talk. Within 2 working days we send a written quote, or we say why we will not take the job. The quote states how long it stays open; without a date it lapses if either of us cancels in writing, or if the proposed date has passed.
The contract is formed when you accept the quote (a signature or a clear e-mail) and the deposit has reached us. Until then the slot can go to someone else.
For a distance contract we confirm the booking by e-mail, restating the core of the quote. We may refuse a request if the project does not fit the 3 rooms, the 4 podcast seats, our safety rules or our diary.
4. Services
What is in and out of a job is on the service page and in the quote. In short:
- Vocal recording — an 11 m² booth with an engineer, for singing, spoken word and reference takes.
- Mixing — balance, dynamics and space for singles, EPs and albums.
- Mastering — final polish for streaming, vinyl or broadcast, with the delivery files we agreed.
- Podcast recording — a table for two to 4 voices, including the basic edit named in the quote.
- Voice-over & dubbing — voice-over and dubbing with timing and several takes.
We work by appointment. Hours: Monday–Friday 10:00–19:00, Saturday 11:00–17:00 (by appointment only). Closed on Sunday. The studio is on Overtoom in Oud-West. Trams 1 and 12 serve the Overtoom (Vondelpark) stop; from there it is about a five-minute walk. You can lock your bike at the racks along Overtoom in front of the building.
Extra time, extra stems, a vinyl pre-master or another variant is charged only if it is on the quote or if you add it later in writing.
5. Prices and VAT
Prices on the site and on the quote are in euros. For consumers they include 21 % VAT. For business clients we also show the amount excluding VAT. The price that counts is the one on the accepted quote.
Guide prices (including VAT): Vocal recording €95 per hour, half day €340, full day €620; Mixing €185 per track or €88 per hour in the studio, EP up to six tracks €540; Mastering €98 per track, album up to twelve tracks €395, stem master €145; Podcast recording €112 per recording hour, €295 per episode up to 60 minutes raw, season bundle €2,480; Voice-over & dubbing €118 per hour, half day €425, small project €780.
If you overrun the booked block at your request, we charge the extra time per half-hour started at that service’s hourly rate, if the next booking allows it. The full list is on services and rates.
6. Deposit and payment
On booking you pay 30 % of the VAT-inclusive price. That is a deposit (a part-payment), not a sum that we keep automatically if we are the ones who fail to perform. The balance follows the quote: for a studio session usually on the day, for remote work (mix, master) when we deliver the version you accept as final.
Payment method: as stated on the quote, in practice a bank transfer to the account on the invoice. We start the session or send final files only once the sum due is in, unless consumer law gives you another timetable.
Business clients pay within 14 days of the invoice date. After that date, statutory commercial interest and the fixed collection costs under the Dutch extrajudicial collection costs decree are due without a further notice of default. Consumers first receive a reminder with at least fourteen days to pay; after that, statutory interest and the statutory collection-cost scale apply.
7. Cancellation and rescheduling by you
| When | Effect |
|---|---|
| 7 days or more before the session | Cancel or move at no charge. If you cancel, we refund the deposit within fourteen days. |
| Fewer than 7 days, or a no-show | We keep the deposit, except in force majeure or if you still validly withdraw as a consumer. |
A move is possible only if a free block exists. Arriving late shortens the booked time; we do not extend the session if the next client is waiting. Cancel or move by e-mail to [email protected], or call first and confirm in writing. This studio rule does not cut down a consumer’s statutory right of withdrawal.
8. Consumer right of withdrawal
If you conclude the contract as a consumer at a distance (form, e-mail, phone) or off-premises, you may withdraw within fourteen days of conclusion, without giving a reason. That right does not apply to a contract you sign at the studio.
If you want the session or the work to start inside those fourteen days, you must ask for that expressly. If you then withdraw, you pay the proportionate part up to the moment of withdrawal. Once the service has been fully performed inside the period, after your express request and your statement that you lose the right to withdraw, you can no longer withdraw. The same applies to work clearly made to your specification, such as a mix or master following your notes.
Withdraw in unambiguous wording by e-mail to [email protected] or by post to Overtoom 141, 1054 HG Amsterdam. You may use the model below. We refund within fourteen days of receiving the withdrawal, using the same means of payment, unless we agree otherwise.
Model withdrawal form
To Cijativojaconsulting B.V., Overtoom 141, 1054 HG Amsterdam, [email protected]:
I/We (*) hereby give notice that I/we (*) withdraw from my/our (*) contract for the following service:
- Ordered on (*):
- Name of consumer(s):
- Address of consumer(s):
- Signature (only if this form is notified on paper):
- Date:
(*) Delete as appropriate.
9. Cancellation or change by the studio
If we have to drop a session — a fault, a sick engineer, an unusable building — we tell you as soon as we can and offer a new date. If that date does not work, we refund everything you have already paid within fourteen days. We do not swap the planned engineer without your agreement.
A small shift of the start time (up to thirty minutes) because the previous session overran is not a cancellation; we make up the lost minutes later that day if the diary allows, or we credit them.
10. How sessions run
We receive people from age 16. Until eighteen, a legal guardian books and pays and is present during the session, or names an accompanying adult in writing. We do not start a session with anyone under 16.
You use rooms and equipment as the engineer instructs. Smoking and vaping indoors are not allowed. If you put people or gear at risk, we stop the session; the booked block remains payable. Damage caused by your fault or neglect is invoiced to you. Instruments and laptops you bring stay at your risk; insure them or keep them under your control.
For your hearing we work at moderate monitor levels, take breaks and offer earplugs on request. The live room is 26 m²; how many players fit at once is set in the quote. Practical prep: preparing vocals and the FAQ.
11. Files, delivery and archive
Delivery is as the quote says, usually WAV or another agreed format, via a download link or on a drive you bring. Mix and master deadlines run from the moment we have complete, playable files. They are counted in working days. Default containers and loudness are on mastering and in the formats guide.
We keep a copy of the session for 12 months after the last working day on the project. After that we delete the copy. You store your own safety copy inside that window. Longer retention is possible only in writing and at the price in a follow-up quote.
12. Revisions
Mixing and Mastering include 2 revision rounds unless the quote states another number. One round is one bundled list of notes that we handle in a single pass. An extra round, or a new artistic direction after you signed off a version, gets a new price.
An hourly Vocal recording, Podcast recording or Voice-over & dubbing session has no separate revision round; what we capture in the block is the delivery, plus the basic edit named in the quote. How to plan a mix budget is in the mix-budget guide.
13. Intellectual property
Your works. Compositions, lyrics and arrangements you bring remain yours or their rightsholders’. You warrant that you have the permissions you need for covers, samples, beats and guests, and that you make any filings with collective management organisations. The studio claims no copyright in your compositions.
The fixation. Whoever initiates and funds the first fixation is usually the phonogram producer. If you commission and pay for the session, that status sits with you. To the extent Cijativojaconsulting B.V. could still claim neighbouring rights in takes we make for you, we assign them once the invoice is paid in full.
Performers. Fixing and exploiting a performance needs the singer’s, player’s or voice-over’s consent. You arrange that with everyone you bring. On a podcast or e-learning job it is your task to brief guests; see podcast rights and consent.
Voice and AI. We do not use your recordings to train, test or improve a model, and we do not build a voice clone without a separate written instruction from the person concerned.
Credits. We do not put your name or title on the site or mention it to third parties without your written OK.
14. Liability
We take reasonable care to perform the job to a professional standard. The artistic result also depends on what you bring; we give no guarantee of outcome. Liability arises only for an attributable breach, and only for direct loss that was foreseeable when the contract was formed.
This cap does not apply in case of intent or wilful recklessness, personal injury, or where mandatory consumer law says otherwise. Towards business clients our total liability per job is limited to that job’s VAT-inclusive invoice, except in case of intent or wilful recklessness; consequential loss (lost turnover, a missed release, extra studio hire elsewhere) is excluded as against business clients.
You indemnify us against third-party claims that follow from material you supply or from exploitation for which you had no rights, unless the loss comes from us.
15. Force majeure
A failure that cannot be attributed to us or to you — for example a long power cut, a ban on gathering, or illness that leaves no engineer available — suspends the affected duty. The party it hits reports it as soon as is reasonable.
The session is moved. If the obstacle lasts more than twenty-eight days or we cannot find a date, either party may end the contract for the outstanding part. Sums prepaid for work not delivered are refunded. Work already delivered remains payable.
16. Personal data
We process contact and project data to reply, schedule and invoice, as the privacy policy describes. The form is relayed by FormSubmit in the United States; an explanation and the alternative (direct e-mail or phone) are in the legal notice.
We keep voice recordings for 12 months. Business clients who give us data about guests, narrators or staff sign the data processing agreement. Cookies and the key cjtv_consent_v1 (182 days) are in the cookie policy; you change them through .
17. Complaints
A complaint about a session, a file or an invoice goes to [email protected] or to Overtoom 141, 1054 HG Amsterdam. We acknowledge receipt and reply on the substance within 2 working days, or we say when the answer will follow if the file needs more time.
We are not a member of a dispute committee. If talks stall, a consumer can seek information from ConsuWijzer (the Netherlands Authority for Consumers and Markets) and then go to the competent court. A business client uses the court in article 18.
18. Governing law and forum
Dutch law governs these terms and the contract. Mandatory consumer protection in the country where the consumer lives remains untouched.
A consumer may start proceedings in the court of their domicile or in the court in Amsterdam. We sue a consumer only in that consumer’s domicile. Disputes between the studio and a business client go to the competent chamber of the District Court of Amsterdam.
19. Final clauses
If a sentence is void or unreasonably onerous, the other sentences stay. We replace the broken sentence with a valid rule that stays as close as possible to the aim. Not relying on a clause is not a waiver.
We may change these terms. A running job keeps the version that applied when you accepted the quote, unless a statute forces an earlier change that does not harm you as a consumer. Version: 1 October 2026, effective 1 October 2026.
